Universal Rail Systems Inc. (“URS”) and URS Group of Companies (collectively the “URS Group”) are committed to protecting the privacy of personal and business information which is collected, used, and disclosed in the conduct of our business. We strive to protect all personal information collected and to be transparent in how personal information is collected, used, and disclosed. We have policies and procedures in place to protect your privacy and ensure personal information is protected from unauthorized use, access, and disclosure.
Application of Policy
This Policy applies to the URS Group’s use, collection and disclosure of personal and business information acquired from users of URS Group’s services, including access to the URS Group website(s).
This Policy does not apply to the personal information of URS Group employees collected in the course of their employment with URS Group.
Consent and Rights
By using URS Group services, including the use of the URS Group websites, you are consenting to this Policy and the URS Group’s collection, use, and disclosure of your personal information as described in this Policy.
Your consent to this collection, use, and disclosure of your personal information is ongoing and continuous.
You may have the following rights related to your personal information collected from URS Group:
- to request a copy of your personal information.
- to request the deletion of your personal information.
- to object to, or request a restriction of, URS Group’s use of your personal information.
- if there are errors in your personal information, request a correction to your personal information.
- to request the transfer of your personal information to another party for its use; and
- to not face discrimination for exercising your available rights.
You are entitled to withdraw your consent at any time, but such withdrawal of consent, or request for deletion or restriction, may affect your ability to access services, products, and programs from URS Group.
Collection of Personal Information
We collect information in connection with the use of our services and products, use of our websites, and use and registration for our courses and training.
We may also collect certain contact information from our clients, such as name, business address, business email address, business phone number or similar business information, which is generally considered to be business contact information.
Similarly, when we collect contact information from individuals acting on behalf of an organization, who register for courses and training because it is required, or allowed, and this information is also considered to be business contact information.
When business contact information is being collected, used, or disclosed for the purposes of contacting an individual in relation to their business responsibilities, it is not generally considered to be personal information and is not covered by this Policy.
However, when the business contact information is being collected, used, or disclosed for another purpose, or personal information other than business contact information is being collected, used, or disclosed, it is treated as personal information under this Policy.
Personal information is collected by us directly from you via our websites, telephone, mail, facsimile, e-mail and in person. This information may include, but is not limited to:
- Identifiers such as names, birthdates, addresses, phone numbers, email addresses, and other contact information.
- Usernames.
- Employment history, education information and other information provided by you in the context of job applications or training courses.
- Your role in an organization if your interaction with us is on behalf of an organization.
- Credit card information.
- Your purchase or registration history with respect to our products, services, courses and/or training.
- Your personal identification documents, such as your driver’s license; and
- Names of services, products, courses and/or training in which you are interested.
Our website may also collect information, such as captured computer information, navigation, and clickstream data.
Some of the information collected does not identify who you are. Other information, such as your domain name or IP address, may identify you depending on the naming standards followed by your Internet service provider. You may wish to ask them about their policies and practices.
While we make no attempt to link the information captured to the identity of individuals, the information captured may identify the following:
- The Internet domain and IP address from which you access our websites.
- The type of browser and operating system used to access our websites.
- Screen resolution of your monitor.
- The date and time you accessed our websites; and
- The pages you visited on our websites.
This information is used to help us make our websites more useful to our audiences by learning about the number of visitors to our websites, and by monitoring traffic patterns and the types of technology that our visitors use.
We do not track or record information about specific individuals and their visits, except to the extent this information is recorded using cookies.
You have the ability to manage cookies through your browser and limiting such information is not the responsibility of URS Group.
Our websites may contain links to other sites. We are not responsible for the content and the privacy practices of other websites and encourage you to examine each site’s privacy policy and disclaimers and make your own decisions regarding the accuracy, reliability, and correctness of material and information found.
We may receive personal information about you from other sources such as your employer, government departments, agencies which work on behalf of governments, WCB (or similar organization), our agents, our service providers, someone acting on your behalf and from publicly available sources.
For example, sometimes we receive information from third parties when we process credit card payments made by you for purchases of products or services, or registrations for courses or training.
Use of Personal Information
Personal information may be collected, used, or disclosed by URS Group for the following business purposes, without limitation:
- Providing you with the products or services you have purchased from us.
- Completing registration for and managing and administering the courses and training you have requested.
- Providing you with information related to the URS Group and its services, products, courses, and/or training.
- Creating a user profile which includes a record of the courses you have completed and could include other information about activities in which you have engaged with us and/or your purchase history of our products and services.
- Communicating with you regarding any products, services, courses and/or training in which you might be interested.
- Processing payments, refunds, and credits.
- Communicating with you and responding to any inquiries made verbally, through email, letter mail or our websites.
- Optimizing the functionality of the URS Group website; and
- Such other collection, use, or disclosure as may be necessary, permitted, or required by law.
When we use your personal information for the purposes described above, that use may include sharing your personal information within the URS Group for business purposes and/or with a third-party service provider for processing or business purposes. In some instances, members of the URS Group or our service providers may be based in the United States or elsewhere outside of Canada and your personal information may be stored outside of Canada.
If you wish to opt-out of receiving communications from us, such as marketing and notifications about our courses or training opportunities that might be of interest to you, you can do so by deactivating your account on the website through the settings.
Please note, you cannot opt out of required communications, such as required notices. For example, we will provide notices that your certification is about to expire.
Disclosure and Storage of Personal Information
Personal information will only be retained by URS Group for the period of time necessary to fulfill the purposes for which it was collected or as required by law. Personal information may be used, processed, or stored in Canada or outside of Canada.
While we use every reasonable measure to ensure personal information is safeguarded and to prevent unauthorized access, use, and disclosure, data storage and internet transmission is not guaranteed to be completely secure.
While every reasonable effort is made to protect your personal information, URS Group is not responsible for unauthorized access to, or disclosure of, your personal information when provided to third parties.
We do not lease, sell, or otherwise disclose personal information for marketing purposes except when it is URS Group specific marketing about our products, services, courses, and training.
From time to time, we may partner with or enter into arrangements with another party to provide specific benefits and/or services to our clients or users. This may include data processing or information technology services.
URS Group will only disclose personal information to third parties to the extent necessary to allow the services/benefits to be performed.
Updates and Contact
This Policy may change from time to time. We reserve the right to amend this Policy at any time, for any reason, without notice to you, other than the posting of the amended Policy. You are encouraged to review this Policy regularly in the event that changes and updates are made.
This Policy supersedes all previous notices or policies regarding our privacy practices for websites and third parties.
